05/17/09: COURT OF APPEALS UPHOLDS DISMISSAL OF LAWSUIT AGAINST NEIGHBORHOOD: The Kentucky Court of Appeals has upheld the dismissal of the lawsuit filed against the Copperfield Neighborhood Association. The Court ruled the Association had the authority to amend its Deed of Restrictions to raise the annual dues and that it did so properly. The Court also ruled that every homeowner is a member of the Association. The Kentucky Court of Appeals ruled the Fayette Circuit Court was correct when it granted Summary Judgment in favor of the Association, dismissing the suit. The suit was dismissed last year (See original doc), but an appeal was filed, resulting in the recent decision. Read the Court of Appeals opinion in pdf format.

The lawsuit filed against the Copperfield Neighborhood Association, Inc., challenging the Neighborhood's ability to raise the Association Fee in order to finance the purchase of the Clubhouse Facilities and Pool has been dismissed by the Fayette Circuit Court. Read the opinion in pdf format
